Terms of Service

These Terms of Service form a binding agreement between you and Hakan Kozaklı, operating influgen.ai ("influgen," "we," "our," or "us"), and govern your access to and use of the influgen.ai website, applications, generated media workflows, scheduling tools, analytics, and related services.

By creating an account, starting a free trial, purchasing a subscription or credit pack, connecting a social media account, or otherwise using the service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use influgen.ai.

You must be at least 18 years old to use the service. If you use influgen.ai on behalf of a company, agency, client, or other organization, you represent that you have authority to bind that organization to these Terms.

You must provide accurate, current, and complete registration information, keep that information updated, and maintain only the accounts and seats that are authorized for your use. Each login is personal to the assigned user and may not be shared, sold, rented, or transferred without our written approval.

You are responsible for safeguarding your credentials, devices, and recovery methods and for all activity that occurs under your account. You must promptly notify us at [email protected] if you believe your account or a connected social platform has been compromised.

If you use influgen.ai for clients (for example on an Agency plan), you are responsible for your clients' influencers and content as if they were your own, for having each client's permission to act for them, and for your clients' compliance with these Terms.

If you register or sign in with Google, Sign in with Apple, or an email one-time passcode, you authorize us to rely on the profile, authentication, and account data provided through those services. Your use of those authentication providers is also subject to their separate terms and privacy notices.

influgen.ai is an AI-powered platform for creating and running AI influencers. The service may allow you to create AI characters, upload references, train a face model or voice for a character, generate images and videos, draft captions and content plans, schedule or publish posts to connected channels, let a character's AI agents work on their own, manage review workflows, and analyze performance.

The service uses third-party infrastructure and model providers, including fal.ai for image and video generation (with models from providers such as OpenAI, Kuaishou (Kling) and Black Forest Labs), OpenRouter and Anthropic for text and planning, ElevenLabs for voices, Paddle for payments, and hosting in the European Union. The current list of providers is in our Privacy Policy.

We may add, remove, suspend, or modify features, workflows, limits, models, integrations, and plan entitlements at any time. New features may be subject to additional product-specific terms presented inside the service.

Outputs generated through influgen.ai are created by machine learning systems and may be inaccurate, incomplete, biased, offensive, misleading, low quality, or unavailable. Generated outputs may also resemble content created for other users or generated by other services, and we do not guarantee uniqueness, exclusivity, or freedom from third-party claims.

You are solely responsible for reviewing, editing, approving, and deciding whether to use any generated output before publication, distribution, advertising, monetization, or reliance. influgen.ai does not provide legal, accounting, medical, investment, employment, platform policy, or regulatory advice, and AI outputs must not be treated as a substitute for professional review.

We are not responsible for hallucinations, factual errors, unsafe recommendations, brand safety failures, or offensive or infringing material produced by models, users, or third parties. You assume the risk of using any prompt, suggestion, caption, media asset, or publishing recommendation generated through the service.

You are responsible for all prompts, uploads, reference images, video clips, captions, voice samples, brand assets, character settings, publishing instructions, and other content that you submit to the service (collectively, "Inputs"). You represent and warrant that you own or have all rights, licenses, consents, and permissions necessary to use those Inputs and to allow us and our service providers to process them under these Terms.

You must not submit Inputs or create outputs that infringe intellectual property, privacy, publicity, moral, biometric, contract, or other rights of any person or entity. If your content includes a person's likeness, voice, image, name, or persona, you must have valid and documented permission to use it for the intended purpose.

You remain solely responsible for the legality, truthfulness, substantiation, endorsements, disclosures, and regulatory compliance of all content you publish or instruct us to publish, including any advertising, affiliate, sponsored, political, health, or financial content.

As between you and influgen.ai, and to the fullest extent permitted by applicable law, you retain ownership of your Inputs and the generated images, videos, captions, and other outputs created for your account. Ownership does not excuse you from obtaining any required third-party permissions or complying with these Terms, provider terms, or applicable law.

You grant influgen.ai and our subprocessors a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, format, transform, back up, and otherwise process your Inputs and outputs as necessary to operate, secure, maintain, troubleshoot, improve, and provide the service to you, including serving media files, generating previews, syncing posts, and restoring backups.

We will not publicly market your private generated content as your endorsement without your permission, except that we may use de-identified, aggregated, or statistical information about service usage, performance, and safety to operate and improve the platform.

You may not use influgen.ai for illegal, fraudulent, deceptive, abusive, harassing, defamatory, hateful, exploitative, or sexually explicit activity, or for content that promotes violence, self-harm, terrorism, child sexual abuse material, non-consensual intimate imagery, or unlawful discrimination.

You may not use the service to impersonate a real person without authorization, create non-consensual deepfakes, fabricate endorsements, mislead consumers, manipulate elections, evade platform enforcement, spam audiences, scrape or exfiltrate data, reverse engineer our systems, probe for vulnerabilities, or build a competing model or service using the platform, outputs, or related metadata except where applicable law prohibits that restriction.

We may investigate suspected violations, remove or block content, suspend publishing access, restrict integrations, or terminate accounts if we believe your use creates legal, safety, reputational, technical, or financial risk for influgen.ai, our users, service providers, or third parties.

Each influencer you create has AI agents that can work on their own: research trends, plan and create posts, schedule and publish them, reply to comments and messages, and interact with other accounts, within the autonomy level and permissions you choose. By turning these features on, you authorize the agents to act for you on your connected accounts.

You decide how much the agents may do without your approval, and you can require approval, pause an influencer, or disconnect an account at any time. Everything an agent does on your behalf is treated as your action under these Terms and the connected platform's rules, and you remain responsible for it. Review the autonomy settings and the activity log regularly.

AI agents can make mistakes, misread context, or produce content you would not have approved. To the extent permitted by law, influgen.ai is not liable for posts, replies, messages, or other actions taken by an agent within the permissions you granted.

You may train a face model or clone a voice only from photos, videos or recordings of yourself, of a fictional character you created, or of a real adult who has given you explicit, documented consent for this use. You must be able to show that consent if we ask.

You may not create a character that imitates a real person (including public figures and celebrities) without that person's consent, and you may never create a character based on, or resembling, a minor. We may remove characters, face models and voices that break these rules and close the account.

Face models, face-matching data and cloned voices are biometric data. How we handle them is described in the Privacy Policy, and you can delete them at any time by deleting the character or your account.

Influencers made with influgen.ai are AI-generated and must not be presented as real people. Posts published through the service carry the AI label or disclosure each platform asks for; you must not remove or hide it, and you must follow the AI-content rules of the platforms and laws that apply to you, such as the EU AI Act.

Sponsored posts, brand deals, affiliate links and paid partnerships must be disclosed as advertising under the rules that apply (for example the FTC Endorsement Guides, the UK ASA code or Turkish advertising rules). You are responsible for those disclosures and for any income, contracts and taxes from monetizing your influencers.

Statements on our website about growth or earning money describe what the product is built to do. They are not a promise or guarantee of followers, engagement, income or any other result.

influgen.ai may allow you to connect accounts for Instagram, TikTok, YouTube, Pinterest, X, and other third-party platforms so that you can authenticate, schedule, publish, or retrieve metrics. By connecting an account, you authorize us to store and use the relevant tokens, account identifiers, permissions, and metadata needed to provide those features.

You are solely responsible for complying with each social platform's terms, developer policies, music and advertising rules, community guidelines, disclosure obligations, and API usage requirements. You must maintain all permissions required to post, schedule, or analyze content on those platforms.

Our YouTube features use YouTube API Services. By connecting a YouTube channel you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms), and Google's Privacy Policy (https://policies.google.com/privacy) applies to the data Google handles.

influgen.ai is not responsible for platform rejections, content removals, demonetization, shadowbans, reduced reach, throttling, suspended integrations, revoked permissions, or account bans caused by your content, platform policy changes, outages, or third-party actions. You may revoke an integration at any time through the provider or your influgen.ai settings, but revocation may disable related features.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Purchases made in our iOS app are sold by Apple through the App Store instead, under Apple's terms.

Paid features are offered through recurring subscriptions (Starter, Pro and Agency, billed monthly or yearly) and one-time credit packs. Subscriptions renew automatically at the end of each billing period until cancelled, and you authorize Paddle, or Apple when you subscribe in our iOS app, to charge your selected payment method for subscription fees, applicable taxes and any additional purchases you make, including extra influencers on plans that offer them.

Plan prices, credit allowances, influencer limits and features are shown on our pricing page and at checkout. Each plan grants its credits at the start of every month, including on yearly billing. Credits are used when you run metered actions such as generating images or video, training a face model, cloning a voice or processing media; the credits an action uses are shown in the product before you run it.

Credits do not expire while your account exists. They have no cash value, are not transferable and cannot be exchanged for cash. If your account is deleted, any remaining credits are forfeited.

Changes within a billing period, such as switching between monthly and yearly billing, changing plans or adding or removing extra influencers, are prorated: the difference is charged at once or credited to your next invoice. You can cancel at any time in Billing (or in your Apple ID subscriptions for iOS purchases); your plan stays active until the end of the period you paid for. Refunds are described in our Refund Policy at https://influgen.ai/refunds.

New accounts get a 7-day free trial with 50 credits and one influencer. No payment details are needed for the trial and nothing is charged when it ends. To keep using influgen.ai after the trial, choose a paid plan; until you do, your influencer stops working on its own and the app asks you to pick a plan. Credits left from the trial stay on your account.

Waitlist bonus: the first 1,000 people to join the influgen.ai waitlist receive 100 extra credits when their account is created, in addition to the trial credits. The order is the time of joining; the bonus is given once per person, to the account created with the email address used on the waitlist. Bonus credits follow the same rules as other credits and have no cash value.

Trials are limited to one per person or organization. We may modify, suspend or withdraw the free trial at any time, including where we detect abuse, duplicate sign-ups or violations of these Terms.

Our collection, use, storage, and disclosure of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference. By using influgen.ai, you acknowledge that we may process account data, content data, integration data, usage data, and billing-related information as described there.

Where applicable, we will process personal data in accordance with applicable privacy laws, including the GDPR, UK GDPR, Turkey's Personal Data Protection Law No. 6698 (KVKK), and relevant U.S. state privacy laws. If you require a data processing addendum for business use, you may request one by contacting [email protected].

influgen.ai and its licensors own the service, including the software, workflows, interface design, model routing, compilations, trademarks, logos, documentation, and all related intellectual property rights. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the service during your permitted access period.

Except as expressly allowed by law or by us in writing, you may not copy, distribute, sublicense, sell, lease, modify, translate, decompile, disassemble, reverse engineer, mirror, scrape, or create derivative services from influgen.ai, nor may you remove proprietary notices or use our branding in a way that suggests affiliation or endorsement.

Third-party software, AI models, payment services, and social platforms made available through the service remain subject to their own rights and rules. Nothing in these Terms transfers any ownership in those third-party services to you.

The service is provided on an "as is" and "as available" basis. We do not provide a service-level agreement unless we expressly agree to one in writing, and we do not guarantee uninterrupted operation, fixed response times, error-free performance, or preservation of every output or workflow state.

influgen.ai depends on third-party providers, including fal.ai, Anthropic, Paddle, hosting and storage vendors, email delivery tools, and social network APIs. Delays, outages, rate limits, policy changes, moderation actions, or defects affecting those providers may interrupt or degrade your experience and may prevent generation, publishing, billing, or account recovery.

You may stop using the service and cancel your subscription at any time through the billing settings or by contacting support, but cancellation takes effect at the end of the current prepaid billing period unless applicable law requires otherwise. We may suspend or terminate your access immediately for breach, misuse, fraud, payment failure, legal compliance, security concerns, or risk to users, providers, or third parties.

Upon termination, your right to use the service ends immediately, but provisions that by their nature should survive will remain in effect, including payment obligations accrued before termination, ownership terms, disclaimers, indemnities, liability limitations, and dispute provisions.

You can delete your account at any time in Account settings. Deletion is immediate and permanent: your influencers, content, media, credits and connected accounts are removed and cannot be recovered, and a paid card subscription is cancelled. Copies in our backups are overwritten within 30 days. We keep only what the law requires, such as billing and tax records.

If we terminate your account, we will generally keep your data available for up to 30 days so that you can export it, unless the law or a security, fraud or legal reason requires otherwise.

To the maximum extent permitted by law, influgen.ai disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, quiet enjoyment, accuracy, or results.

We do not warrant that outputs will be original, lawful, safe, monetizable, factually correct, on-brand, platform-compliant, or suitable for any specific business purpose. We also do not guarantee audience growth, campaign performance, engagement, revenue, follower retention, advertiser approval, or platform distribution outcomes.

To the maximum extent permitted by law, influgen.ai, Hakan Kozaklı, and our affiliates, contractors, service providers, and licensors will not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, or for any loss of profits, revenues, goodwill, business opportunity, reputation, data, or anticipated savings, arising out of or related to the service or these Terms.

Our aggregate liability for all claims arising out of or relating to the service or these Terms will not exceed the total amount you paid to influgen.ai for the service in the 12 months preceding the event giving rise to the claim. If you have not paid us anything, our aggregate liability will not exceed USD 50.

The exclusions and limits in this section apply regardless of the theory of liability and even if a remedy fails of its essential purpose, but they do not limit liability that cannot legally be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where such limitation is prohibited.

You will defend, indemnify, and hold harmless influgen.ai, Hakan Kozaklı, and our affiliates, personnel, contractors, licensors, and service providers from and against any third-party claim, demand, action, proceeding, loss, liability, damage, judgment, settlement, penalty, cost, or expense, including reasonable legal fees, arising out of or related to your Inputs, outputs, published content, connected accounts, use of the service, or breach of these Terms.

This indemnity includes claims relating to intellectual property infringement, privacy or publicity violations, defamation, deceptive advertising, platform policy violations, unauthorized use of a person's likeness or voice, unlawful promotions, and any regulatory or consumer protection issues caused by your content, campaigns, or instructions.

These Terms are governed by the laws of the Republic of Turkey, excluding conflict-of-law principles. Before starting formal proceedings, each party agrees to try in good faith to resolve any dispute by written notice and informal negotiation for at least 30 days.

If a dispute is not resolved informally, it will be finally settled by binding arbitration in Istanbul, Turkey, in the English language, under the Istanbul Arbitration Centre (ISTAC) Arbitration Rules by a single arbitrator. Either party may seek temporary or injunctive relief in a court of competent jurisdiction to protect confidential information, intellectual property, or security pending arbitration.

Nothing in this section prevents either party from bringing an eligible claim in small claims court or limits any non-waivable consumer protection rights you may have under applicable law.

We may update these Terms from time to time to reflect changes to the service, law, pricing structure, providers, or risk profile. If we make a material change, we will provide at least 30 days' prior notice by email, through the service, or by another reasonable method, unless a shorter notice period is required for legal, security, or abuse-prevention reasons.

The updated Terms become effective on the stated effective date. If you continue to use influgen.ai after the updated Terms take effect, you agree to the revised Terms. If you do not agree, you must stop using the service before the new Terms take effect.

If you believe content made with influgen.ai infringes your copyright, uses your likeness or voice without consent, or is otherwise unlawful, write to [email protected] with a link to the content and why it is unlawful. We review every report and remove content and accounts that break the law or these Terms.
